Pickkl’s Terms of Service

 

Welcome to Pickkl.com.

The following terms of service (these "Terms of Service"), govern your access to and use of the Pickkl website, including any content, functionality and services offered on or through www.Pickkl.com (the "Site").

Please read the Terms of Service carefully before you start to use the Site. By using the Site, opening an account or by clicking to accept or agree to the Terms of Service when this option is made available to you, you accept and agree, on behalf of yourself or on behalf of your employer or any other entity (if applicable), to be bound and abide by these Terms of Service, Pickkl Payment Terms, found at (“Payment Terms”), and our Privacy Policy, each of which is incorporated herein by reference. If you do not want to agree to these Terms of Service or the Privacy Policy, you must not access or use the Site. For more detailed policies surrounding the activity and usage on the Site, please access the designated articles herein.

This Site is offered and available to users who are 18 years of age or older. If you are under 18 you may not use this Site or the Pickkl services. By using this Site, you represent and warrant that you are of legal age to form a binding contract and meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use the Site.

Key Terms

 

Site Members are Vloggers, Bloggers, Video Content Creators and Influencers that sign up and use Pickkl to facilitate paid Q and A interaction between them and their fans or audience. 

Askers are fans that send questions to a certain Site Member for a fee. They are not required to sign up to Pickkl to be able send in their questions

Q and A is an abbreviation for Question and Answer

Unique Link is a url link that is automatically generated by Pickkl after a Site Member has set up their rates on the site. Site Member uses this link to send or share to their fans which in turn use it to see a Site Member’s Q and A rates.

Q and A Page is where a Site Member and Asker communicate with each other with regards to the Questions being asked.

Booking is the formal agreement between a Site Member and Asker after a “purchase” was made from the Site Member’s unique link.


 

Overview (Main terms, in a nutshell)

  • Only registered Site Members are allowed to use the Pickkl website. Registration is free. In registering for an account, you agree to provide us with accurate, complete and updated information and must not create an account for fraudulent or misleading purposes. You are solely responsible for any activity on your account and for maintaining the confidentiality and security of your password. We are not liable for any acts or omissions by you in connection with your account.

  • Site Members can set their rates with respect to the number of questions they are willing to answer on their Pickkl dashboard.

  • Askers pay Pickkl in advance to create a booking (see Payment Terms).

  • Bookings are purchased through the “Book Now” button found on a Member’s unique link.

  • For fees and payments please read the Payment Terms

  • Site Members must fulfill their bookings (Answer the questions being sent truthfully, and may not cancel bookings without cause. Cancelling bookings will affect Member’s reputation and status.

  • Site Members may not offer or accept payments using any method other than placing a booking through Pickkl.com.

  • We care about your privacy. You can read our Privacy Policy. The Privacy Policy is a part of these Terms of Service and incorporated herein by reference.

 

SITE MEMBERS

Basics

  • Site Members set up Q and A rates on Pickkl to allow their Fans to purchase their Q and A services.

  • Site Members should be aware that you are solely responsible of the quality of answers you give to your Fans.

  • Each booking you sell and successfully complete accredits your account with a revenue equal to 100% of the purchase amount.

  • Pickkl accredits Members once a Q and A transaction is completed.

  • For more information about receiving payments, fees and taxes see the Payment Terms.

  • Sellers may promote their unique link via their pages and channels (Youtube, Facebook, Instagram, Twitter)

  • For security concerns, Pickkl may temporarily disable a Member’s ability to withdraw revenue to prevent fraudulent or illicit activity. This may come as a result of security issues, improper behavior reported by other users.

Q and A Rates Set-up

  • Site Members are allowed to set up Q and A rates under these limitations:

  • Minimum rate to be set should not be less than 100 Pesos.

  • Maximum allowable number of Questions to answer is only 10.

  • Site Members are allowed to change or revise his/her Q and A rates whenever he/she may feel so.

 

ASKERS

Basics

 

  • You are not required to sign up or register to Pickkl to book a Q and A transaction but you are still bound to this Terms of Service.

  • Please refer to the Payment Terms for making Payments through the Pickkl platform and to learn about charges and fees.

  • You may not offer Site Members to pay, or make payment using any method other than through the Pickkl.com site. In case you have been asked to use an alternative payment method, please report it immediately to support@pickkl.com

 

BOOKINGS

Basics

  • For Asker, upon clicking the “Book Now” button from a Site Member’s unique link, you will be required to enter your email address for transaction monitoring purposes.

  • A unique code will be generated as your password to unlock answers at the “See Answers” page in the Pickkl site.

  • When there is a booking, a notification icon pops up in the Pickkl site.

  • Once the Site Member completes to answer the questions, an email notification will be sent to the Asker.

 

Disputes and Cancellations

Any dispute arises during the transaction. You can email support@pickkl.com

User Protection

Basics

  • To protect our users' privacy, user identities are kept anonymous. Requesting or providing Email addresses, Skype/IM usernames, telephone numbers or any other personal contact details to communicate outside of Pickkl in order to circumvent or abuse the Pickkl platform is not permitted.

  • Pickkl does not provide any guarantee of the level of answers sent to Askers. You may email us at support@pickkl.com for disputes.

  • All Q and A interactions must be performed exclusively on Pickkl platform.

  • Rude, abusive, improper language, or violent messages will not be tolerated and may result in an account warning or the suspension/removal of your account.

  • Pickkl is open to everyone. Discrimination against a community member based on gender, race, age, religious affiliation, sexual preference or otherwise is not acceptable and may result in the suspension/removal of your account.

  • Users may not submit proposals or solicit parties introduced through Pickkl to contract, engage with, or pay outside of Pickkl.

 

Reporting Violations

If you come across any content that may violate our Terms of Service, you should report it to us through the appropriate channels created to handle those issues as outlined in our Terms of Service.

 

Violations

Users may receive a warning to their account for violations of our Terms of Service and/or our Community Standards or any user misconduct reported to us. A warning will be sent to the user's email address.

 

Non-Permitted Usage

Adult Services & Pornography - Pickkl does not allow any exchange of adult oriented or pornographic materials and services.

Inappropriate Behavior & Language - Communication on Pickkl should be friendly, constructive, and professional. Pickkl condemns bullying, harassment, and hate speech towards others.

Phishing and Spam - Members’ security is a top priority. Any attempts to publish or send malicious content with the intent to compromise another member’s account or computer environment is strictly prohibited.

Privacy & Identity - You may not publish or post other people's private and confidential information.

Fraud / Unlawful Use - You may not use Pickkl for any unlawful purposes or to conduct illegal activities.

 

General Terms

  • Pickkl reserves the right to put any account on hold or permanently disable accounts due to breach of these Terms of Service and/or our Community Standards or due to any illegal or inappropriate use of the Site or services.

  • Violation of Pickkl’s Terms of Service may get your account disabled permanently.

  • Users with disabled accounts will not be able to login to Pickkl.

  • Users who have violated our Terms of Service may contact support@pickkl.com for the information surrounding the violation and status of the account.

  • Users must be able to verify their account ownership through Customer Support by providing materials that prove ownership of that account.

  • Pickkl may make changes to its Terms of Service from time to time. When these changes are made, Pickkl will make a new copy of the terms of service available on this page.

  • You understand and agree that if you use Pickkl after the date on which the Terms of Service have changed, Pickkl will treat your use as acceptance of the updated Terms of Service.

Payment Terms
Key Terms

Capitalized terms used but not defined herein shall have the respective meanings given to them in the Terms of Service. 

Pickkl Earnings is the aggregated amount of your Revenue as a Site Member.

Payment Services Provider(s) are service providers that provide payment services to Askers.

Revenue is the money that Site Members earn from completed Q and A transactions and can be withdrawn anytime.

Receiving Payments

General 

  • Each Q and A transaction you successfully complete, accredits your account with revenue equal to 100% of the rates you have set.

  • Pickkl accredits Site Members once a Q and A booking is completed.

  • If a booking is cancelled (for any reason), the funds paid will be returned to the Asker by e-wallet transfer.

  • Pickkl partners with Payment Services Providers for purposes of collecting payments from Askers and transferring such payments from Pickkl to the Site Members. All payments services in connection with the withdrawal of funds on the Pickkl platform are performed by Pickkl’s Payment Services Providers.

Withdrawing Revenues

  • To withdraw your earnings, you must have an account with at least one of Pickkl’s recommended e-wallet providers.

  • After you send your withdrawal request, you will have to wait for 5-7 days for the money to be transferred to your ewallet account.

  • For security concerns, Pickkl may temporarily disable a Member’s ability to withdraw earnings to prevent fraudulent or illicit activity.

  • Withdrawals can only be made in the amount available to you.

  • Pickkl does not charge withdrawal fees.

  • Withdrawals are final and cannot be undone. We will not be able to reverse this process once it has begun.

 

Booking

General

  • Askers pay through Pickkl’s chosen payment service provider that is integrated to the site.

  • Askers pay Pickkl to create an order from a Member’s Q and A page, using the Book Now button. Pickkl partners with Payment Services Providers for purposes of collecting all payments from Askers, transferring such payments  to Site Members, and holding funds in connection with Pickkl Balances. All payments services in connection with the collection of funds on the Pickkl platform are performed by Pickkl’s Payment Services Provider.

  • Pickkl serves as Member’s limited authorized payment collection agent solely for the purpose of accepting payments (via its Payment Services Provider, if applicable) from Asker, and remitting those payments to Members. Asker’s payment obligation to Member will be satisfied upon receipt of payment by Pickkl (or its Payment Services Provider, as applicable), and Pickkl (via its Payment Service Provider, as applicable) is responsible for remitting the funds to the Member in the manner described in these Payment Terms. In the event that Pickkl (via Payment Services Provider) does not remit any such amounts to Member, the Member will have recourse only against Pickkl and not the Asker directly.

  • Booking purchases on Pickkl can be made by using one of the following payment methods: Credit Card, Gcash and Grabpay. 

  • Service fees are added at the time of booking where you can review and accept the total amount requested to pay. These fees cover administrative fees. The service fee is 10% of the booking amount across all rates.

  • You may not offer Members to pay, or make payment using any method other than through the Pickkl.com site. In case you have been asked to use an alternative payment method, please report it immediately to Customer Support.

  • You agree to receive invoices and/or payment receipts from Pickkl in electronic form as PDF documents, by email or through the Site.

  • To protect against fraud, unauthorized transactions (such as money laundering), claims, or other liabilities, payment information in connection with withdrawals is collected by either Pickkl or Pickkl’s Payment Services Providers. Payment Services Providers may also collect such other information as necessary for the purpose of processing withdrawal payments.  Pickkl is not exposed to the payment information provided to Payment Services Providers, and this information is subject to the privacy policy applicable to the Payment Service Provider. Please see our Privacy Policy for more information.

  • By using any payment method and/or providing payment details for making purchases on Pickkl, you represent and warrant that: (a) you are legally authorized to provide such information; (b) you are legally authorized or have permission to make payments using the payment method(s); (c) if you are an employee or agent of a company or person that owns the payment method, you are authorized by that company or person to use the payment method to make payments on Pickkl; and (d) such actions do not violate any applicable law.
